    <description>An order deciding a preliminary territorial jurisdiction objection is appealable only if it finally determines the parties&#039; rights so far as the court is concerned. Where the plaint may still be returned for presentation to the proper court under Order 7 Rule 10 CPC, the ruling is not a final adjudication and remains prima facie at the preliminary stage. The existence of a cause of action within the forum does not by itself make such an order final for appeal purposes. On that basis, the appeal was not maintainable.</description>
