    <title>2009 (1) TMI 916 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=198771</link>
<description>A Lok Adalat award passed on a voluntary compromise in a cheque dishonour matter has the force of a civil court decree under the Legal Services Authorities Act, 1987, and is final, binding and executable between the parties. Once the compromise is recorded and the award becomes final, the unsuccessful party cannot resile from it. A later objection that the executing civil court lacked pecuniary jurisdiction does not defeat execution, because the statutory scheme gives the award decree-like effect and such an objection cannot be used to frustrate settlement. Execution was therefore permitted to proceed.</description>
