    <title>2011 (3) TMI 1752 - DELHI HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=197977</link>
<description>The TATA mark was treated as a well-known trade mark because of its long use, wide market presence, substantial goodwill and repeated judicial recognition, bringing it within enhanced protection under the Trade Marks Act, 1999. Unauthorised use of A-ONE TATA on similar goods, and use of the stylised T device on invoices and business cards suggesting a commercial association, were found to amount to trade mark infringement and passing off. Deliberate misuse of the mark on weighing scales and spring balances was also held to justify punitive damages, on the basis that token relief would not deter trademark piracy or protect brand equity.</description>
