    <title>2010 (2) TMI 1246 - BOMBAY HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=194934</link>
<description>A claim under Section 33-C(2) of the Industrial Disputes Act for interest on an adjudicated amount remained maintainable despite delayed filing, because the underlying right accrued during employment and the delay stemmed from the employer&#039;s continued non-compliance. Cessation of the employment relationship did not defeat the claim, no further evidence was required on admitted facts, and res judicata did not apply since the earlier proceedings had not claimed interest. The Labour Court was held competent to award interest on delayed payment under the Interest Act, 1978 and, additionally, in exercise of equitable jurisdiction under Article 226. Future interest could be pursued separately.</description>
