    <title>2008 (3) TMI 732 - CALCUTTA HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=194523</link>
<description>Delay in seeking revocation of probate was not condoned because the petitioner&#039;s claimed first knowledge was inconsistent with its earlier participation in the same dispute through its controlling mind, and notice was therefore attributable much earlier than alleged. The Court also held that the revocation petition could not be used to reopen a controversy already conclusively decided in prior proceedings culminating in the Supreme Court&#039;s judgment, as that would undermine finality and amount to an abuse of process. On both grounds, the challenge to the probate grant failed.</description>
