    <title>2009 (5) TMI 966 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=194238</link>
<description>Interest on compensation for a railway accident claim may be awarded even without an express provision in the Railways Act, 1989, because compensatory interest can be granted in judicial discretion under the Interest Act, 1978 and Section 34 of the Code of Civil Procedure, 1908. The Court treated interest as compensation for delayed use of money and held that, where the claim was promptly made but payment was delayed, interest could run from the date of the application until the award and continue until actual payment. The default-only interest direction was therefore set aside.</description>
