    <description>A final arbitral award, once the challenge to it has failed and it is enforceable under the Arbitration and Conciliation Act, 1996, may be treated as a decree or order for issuing an insolvency notice under Section 9(2) of the Presidency Towns Insolvency Act, 1909. Applying Sections 35 and 36, the Court treated the award as binding and enforceable in the same manner as a court decree, and held that there was no material distinction for this purpose between a decree and a final arbitral award. The objection to insolvency proceedings based on the award was therefore rejected.</description>
