    <title>2009 (4) TMI 992 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=193969</link>
<description>A criminal court judgment is not, by itself, evidence of civil liability in a later civil suit, except to the limited extent permitted by Section 43 of the Evidence Act; however, an admission made by a party in the civil proceedings is admissible under Section 58 and may be relied on without further proof. For a suit to recover pledged or pawned movable property, Article 70 of the Limitation Act applies and time runs from refusal after demand. On the pleaded and admitted facts, the demand and refusal were proved, the suit was filed within three years, and limitation did not bar the claim.</description>
