    <title>1935 (12) TMI 31 - Privy Council</title>
    <link>https://www.taxtmi.com/caselaws?id=193136</link>
<description>Territorial jurisdiction for a contract claim may arise at the creditor&#039;s residence where the contract fixes no place of payment. Under the rule that a debtor must seek out and pay a creditor residing within the realm, the creditor&#039;s residence constitutes an implied place of performance. Section 20(c) of the Code of Civil Procedure permits suit institution where the contract is to be performed or money is expressly or impliedly payable. The contrary view that the Contract Act prevents this inference does not govern where no payment location can be inferred from the agreement.</description>
