    <title>2006 (7) TMI 697 - DELHI HIGH COURT</title>
    <link>https://www.taxtmi.com/caselaws?id=193111</link>
<description>An arbitral award on agreed terms, once enforceable as a decree under the Arbitration and Conciliation Act, 1996, cannot be collaterally attacked in execution on grounds that would require setting it aside. The Usurious Loans Act, 1918 applies only to suits of the kind it specifically contemplates and does not govern execution of such an award. An executing court must take the decree as it stands and cannot re-examine the underlying transaction unless the decree is void or suffers from patent lack of jurisdiction. Where no petition under Section 34 was filed, objections in execution cannot be used as an indirect challenge to the award.</description>
