    <description>A puisne mortgagee impleaded in an earlier mortgage suit is primarily entitled to redeem the prior mortgage and share any surplus sale proceeds; if the prior mortgage debt has already been satisfied and no sale has occurred, the earlier decree does not bar a separate suit on the puisne mortgage. The separate suit was therefore maintainable. On interest, mortgage decrees are governed by Order 34, and after the 1929 amendment the court has discretion over pendente lite and subsequent interest rather than being bound by the contractual rate. The contractual 12% rate with monthly rests after suit was reduced to simple interest at 6% per annum from the date of suit.</description>
