    <title>1984 (11) TMI 349 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=188940</link>
<description>A presidential expectation that a Prime Minister seek the Lok Sabha&#039;s confidence within a stated period may carry political significance, but it does not by itself create a constitutionally enforceable condition for continuance in office. On that basis, the Prime Minister&#039;s continued office was not unconstitutional for want of a fresh mandate. Continuation as a caretaker Government also did not amount to a new appointment, so no fresh oath of office was required for the Prime Minister or ministers. The challenge to their continued office therefore failed, and the appeal was dismissed.</description>
