    <description>A decree passed against a person of unsound mind without appointment of a guardian ad litem under Order 32 Rule 15 CPC is treated as void and non est, because the court acts without jurisdiction. An execution sale founded on such a decree is also void ab initio and cannot confer title on the purchaser. The protections applicable to confirmation or setting aside of execution sales do not apply where no valid decree existed at the time of sale. On that basis, the challenge to the purchaser&#039;s title failed and the suit for possession was dismissed.</description>
