Failure to affix the sale notice on a conspicuous part of the land under Section 36 was held to be a vitiating illegality, not a mere irregularity under Section 38, because the requirement protects identification of the property, bidder awareness and fair price. Selling the entire property, instead of only the portion necessary to realise the dues, breached the proviso to Section 44 and was likewise held illegal. The revenue auction sale was therefore set aside.</description>
