    <title>2008 (8) TMI 934 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=184465</link>
<description>A civil suit for recovery on dishonoured cheques may proceed alongside a complaint under Sections 138 and 142 of the Negotiable Instruments Act, 1881, but compensation already paid or recovered in the parallel criminal proceeding under Section 357 CrPC must be taken into account in the later civil decree. The civil court is bound to adjust such sums when awarding compensation in a subsequent suit arising from the same transaction, and the appellate court, as a continuation of the suit, may correct any omission to do so. The decree therefore required modification and recalculation to reflect the compensation already deposited.</description>
