    <title>1973 (7) TMI 112 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=179342</link>
<description>A suit for ejectment and possession of bhumidhari land occupied without title fell within Section 209 of the Uttar Pradesh Zamindari Abolition and Land Reforms Act, 1951. Because Section 331 barred cognizance by ordinary civil courts and Schedule II assigned such suits to the Assistant Collector, First Class, the civil court lacked jurisdiction to entertain the claim. A decree passed by a court without such exclusive statutory jurisdiction was incompetent and could be challenged even at a later stage. The plaintiffs&#039; claim was therefore upheld as dismissed on the ground of want of jurisdiction.</description>
