    <description>Writ relief under Article 226 is ordinarily inappropriate for enforcing a life insurance claim where repudiation gives rise to disputed facts and the dispute requires evidence; in such cases, the claimant should be driven to a civil suit. Section 45 of the Insurance Act, 1938 permits repudiation of a life policy only if the insurer proves that the statement related to a material matter, that the suppression was fraudulent, and that the policy-holder knew the statement was false or knowingly suppressed the fact. Mere inaccuracy or suspicion is insufficient. On that basis, repudiation is valid only when all statutory conditions are established.</description>
