    <title>1984 (9) TMI 294 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=174221</link>
<description>Section 433A of the Code of Criminal Procedure, 1973 applies only to a person actually undergoing life imprisonment for a capital offence and does not override the Andhra Borstal Schools Act, 1925. A qualifying adolescent offender transferred to a Borstal School under section 10-A is deemed to be under Borstal detention, not prison imprisonment, and remains governed by the special rehabilitative scheme of that Act, including the age limit of twenty-three years and the limited transfer-back mechanism under section 14. The special local law was therefore treated as prevailing over the general remission restriction in section 433A.</description>
