    <description>Civil court jurisdiction under Section 9 CPC is presumed unless excluded by express words or necessary implication, so a suit challenging termination may proceed where the claim is based on constitutional violations, breach of statutory regulations, common law obligations, or denial of natural justice. The mere availability of remedies under the Industrial Disputes Act, 1947 or Certified Standing Orders does not itself bar a civil suit. Where the right and relief arise solely from industrial law or sister enactments with their own forum, civil jurisdiction is unavailable. An order made in breach of mandatory procedure or fundamental fairness may be treated as a nullity, and Article 14 rights may be directly enforced in civil proceedings.</description>
