    <description>Section 50 of the NDPS Act applies to personal search and not to a bag carried on the head; accordingly, the safeguard requiring an option of search before a Gazetted Officer or Magistrate is not attracted to such a recovery. In prosecutions under the Act, the prosecution must also prove an unbroken and reliable chain of custody for seized samples, including safe storage and timely dispatch to the laboratory. Where the evidence does not reliably show where the samples remained between malkhana removal and laboratory receipt, the integrity of the samples is compromised and the conviction cannot be sustained on that basis.</description>
