    <title>2007 (1) TMI 560 - HIGH COURT OF PUNJAB AND HARYANA</title>
    <link>https://www.taxtmi.com/caselaws?id=173410</link>
<description>Conscious possession of narcotics may be inferred from the surrounding facts and the conduct of the accused, including their presence in the truck, the ownership and driving of the vehicle by one accused, and the absence of any plausible explanation for the contraband. Alleged irregularities in the recovery memo, sampling, seal custody and a delay in dispatching samples to the laboratory were treated as non-fatal because the seals remained intact and the chain of custody was preserved. Non-examination of the independent witness and an unproved alibi did not displace the consistent testimony of the official witnesses. The convictions and sentences were upheld.</description>
