    <title>1956 (11) TMI 35 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=171558</link>
<description>A proviso dispensing with communication of detention grounds in security-of-State cases must be invoked within the same statutory period allowed for prompt communication under section 8(1) of the Jammu and Kashmir Preventive Detention Act, 2011. The power to declare non-disclosure in the public interest is co-terminous with the detainee&#039;s right to receive grounds as soon as may be, because a delayed declaration would defeat the safeguard and the right to make an earliest representation. A declaration made after expiry of that period cannot cure the defect, and the detention is then not in accordance with the prescribed procedure and becomes illegal.</description>
