    <description>Preventive detention requires effective communication of the grounds in a language and form understood by the detenue within the time required by Article 22(5); service of an English text to a person who does not understand English is insufficient, and a belated translation does not cure the defect. A fresh detention order after revocation under Section 13(2) of the Preventive Detention Act, 1950 can be made only on fresh facts arising thereafter, not on the same grounds as the earlier order. On these principles, both detention orders were unsustainable and release followed.</description>
