    <title>1991 (11) TMI 253 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=168904</link>
<description>Properties held by an absolute sovereign retain the incidents of sovereign ownership unless a separate family title is specifically pleaded and proved; on the record, the disputed properties were treated as the ruler&#039;s personal assets, not tarwad properties, so no partition lay. The Hindu Succession Act, 1956 and the Kerala Joint Hindu Family System (Abolition) Act, 1975 could not alter that character or create a joint family interest where none existed. The plea of Sthanam was also rejected because it was not properly pleaded and no issue was framed, and a new factual case could not be raised for the first time in appeal. The appeals accordingly failed.</description>
