    <title>1986 (9) TMI 405 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=168895</link>
<description>Under Article 227, the High Court could not reappreciate evidence or overturn factual findings of the subordinate courts unless the findings were perverse, without evidence, or involved a manifest error of law; the High Court&#039;s interference was therefore unwarranted. On Section 15A of the Bombay Rents, Hotel and Lodging House Rates Control Act, 1947, a statutory tenant could validly grant a licence before 1 February 1973, and a person in occupation as such a licensee on that date was entitled to statutory protection as a tenant. The appeal succeeded and the High Court&#039;s order was set aside.</description>
