    <title>1959 (4) TMI 23 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=168801</link>
<description>A trust deed must be read as a whole to determine whether the dedication is private or public. Here, the provision for temples, deities, open worship, large festivals, trustees outside the family, and a separate charitable hospital and dispensary showed a public religious and charitable trust rather than a family endowment. Section 3 of the Bihar Hindu Religious Trusts Act, 1950 was construed to apply where the trust was situate in Bihar and had sufficient territorial nexus through property and objects within the State. The statute was therefore held not to have impermissible extra-territorial operation.</description>
