    <title>1969 (8) TMI 80 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=168602</link>
<description>A Hindu widow&#039;s adoption under the Hindu Adoptions and Maintenance Act, 1956 was treated as placing the child in the family of her deceased husband, so the adopted child became the adopted son of that husband and acquired coparcenary rights in the joint family property. The joint family character of the property was not lost merely because only one coparcener survived temporarily. Ordinary tenancy rights under the Madhya Bharat Land Revenue and Tenancy Act, 1950 were also held heritable in the absence of a statutory exclusion, so they devolved under personal law and could pass by succession.</description>
