    <title>2014 (4) TMI 548 - ITAT MUMBAI</title>
    <link>https://www.taxtmi.com/caselaws?id=246111</link>
<description>Lease premium paid for grant of leasehold rights in land was analysed on a substance-over-form basis and held not to be rent within section 194-I. The payment was treated as consideration for transfer of substantial leasehold rights, not a periodic amount for use of land, having regard to the lease structure, the developer&#039;s obligations, and the way the premium was computed. On that footing, no tax was deductible at source on the amount, and the demand under sections 201(1) and 201(1A) was deleted.</description>
