    <title>1989 (5) TMI 314 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=160708</link>
<description>In private arbitration under the Arbitration Act, 1940, a non-speaking award is not invalid merely because the arbitrator or umpire has not given reasons. Judicial interference is confined to the limited statutory grounds for remittal or setting aside, and absence of reasons alone does not attract those grounds. Reasons are required only where the arbitration agreement, deed of submission, or a court order expressly so provides, or where some other statutory basis for challenge exists. Where reasons are actually given, the award may still be examined for an error of law apparent on the face of the record.</description>
