<title>Customs – Prohibited Import of goods infringing intellectual property rights</title>
    <link>https://www.taxtmi.com/news?id=42</link>
<description>The Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007 allow a right holder to notify the Commissioner of Customs to suspend clearance of suspected infringing imports upon payment of an application fee and filing of a bond and indemnity. The Commissioner decides whether to register the notice and, if registered, circulates it to customs offices. DC/AC customs may suspend clearance on a registered notice or on prima facie grounds; absent a right holder reference such suspension will lapse after a brief period. Notification No. 49/2007 specifies categories of prohibited imports including false trademarks, false descriptions, design and patent infringements, false geographical indications, and items barred under copyright law.</description>
