    <title>2013 (8) TMI 8 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=235713</link>
<description>Preventive detention orders may be challenged before execution on grounds not confined to the five illustrative exceptions in Alka Subhash Gadia. Long delay in execution, coupled with no fresh prejudicial activity, may break the live link between the original grounds and the preventive purpose, making an unexecuted order stale and unsustainable. Absconding may justify other statutory steps, but it does not by itself preserve a detention order that has lost relevance with time. Where the underlying customs dispute is settled and immunity from prosecution is granted, the basis for continuing preventive detention on the same cause also falls away unless fresh conduct intervenes.</description>
