    <title>2013 (2) TMI 155 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=220750</link>
<description>Violation of Section 25-F does not make reinstatement with continuity of service and back wages an automatic remedy. In the case of a daily wager with only short service, industrial adjudication must weigh the nature of employment, manner of appointment, length of service, the circumstances of termination and the ends of justice before granting relief. The Supreme Court distinguished Harjinder Singh and Devinder Singh on their facts and held that monetary compensation may be the more appropriate remedy where reinstatement is not justified. On that basis, the award of reinstatement was set aside and compensation substituted.</description>
