    <description>Section 437 of the Code of Criminal Procedure permits a Magistrate to grant bail not only to an accused, but also to a person suspected of a non-bailable offence who voluntarily submits to the court&#039;s jurisdiction and is therefore in custody for bail purposes. In customs proceedings, the existence of summons under Section 108, search material, and witness statements indicating possible involvement was sufficient to treat the person as a suspect. The Customs Act did not, on these facts, exclude the Magistrate&#039;s general bail jurisdiction, so the bail order was within jurisdiction and not illegal or excessive.</description>
