    <description>For selection posts, seniority alone does not create an enforceable right to promotion, because merit and experience remain the primary criteria for appointment. Where the statutory rules do not prescribe the method of promotion, the executive may validly issue administrative instructions to supplement the rules, provided they are consistent with them. A merit-based selection system for selection posts does not, by itself, offend Articles 14 and 16, and seniority may operate only as a tiebreaker where merit is equal. The challenge to the promotions therefore failed.</description>
