    <title>2004 (9) TMI 602 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=150972</link>
<description>Section 50 of the Narcotic Drugs and Psychotropic Substances Act, 1985 is confined to a personal search of the accused and does not extend to a bag, suitcase or other container carried by that person. The statutory safeguard cannot be enlarged by interpretation to cover articles distinct from the person himself. Accordingly, non-compliance with Section 50 is not a legal objection to recovery from a bag carried by the accused, and the contrary view treating such search as a personal search was considered incorrect.</description>
