    <title>2011 (3) TMI 1478 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=126959</link>
<description>Section 18 of the SARFAESI Act makes pre-deposit a mandatory condition for entertaining an appeal before the Appellate Tribunal. The borrower must deposit fifty per cent of the debt due as claimed by the secured creditor or determined by the Debts Recovery Tribunal, whichever is less, and the Tribunal may reduce that amount only for recorded reasons to not less than twenty-five per cent. No complete waiver is permissible. Even where the debt has not yet been quantified by the Debts Recovery Tribunal, the deposit requirement still applies by reference to the secured creditor&#039;s claim, and the appeal cannot be admitted without compliance.</description>
