    <title>2008 (9) TMI 626 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=123739</link>
<description>A criminal court becomes functus officio once it has finally disposed of a petition, except for correction of clerical or arithmetical errors. Inherent power under Section 482 of the Code of Criminal Procedure, 1973 cannot be used to reopen, review, or alter a final order where Section 362 bars reconsideration of the same matter. As the modification was sought in the disposed of petition itself, the court lacked authority to revisit the earlier refusal to transfer the investigation, and a direction to the Central Bureau of Investigation was unsustainable. The impugned order was therefore set aside.</description>
