    <title>2007 (4) TMI 369 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=111258</link>
<description>Preventive detention under the detention law may stand independently of adjudication proceedings, so exoneration in collateral proceedings does not by itself invalidate the order unless it shows the allegations to be false, baseless, mala fide, or colourable; on the facts, the detention link remained supported by the material on record, including evasion of arrest and proclamation. Only relevant and material documents must be supplied to enable an effective representation, but the alleged non-supply of the confession and retraction was not established to have caused prejudice; the retraction was already considered by the detaining authority. The SC therefore upheld the detention order and rejected the habeas corpus challenge.</description>
