    <title>2004 (12) TMI 401 - HIGH COURT OF ANDHRA PRADESH</title>
    <link>https://www.taxtmi.com/caselaws?id=111085</link>
<description>An application under section 11(6) of the Arbitration and Conciliation Act, 1996 is maintainable only where an arbitration agreement exists within the meaning of section 7. In a loan dispute, the borrower could not invoke section 11 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 because that provision operates only for disputes among the entities specifically named in it, namely banks, financial institutions, securitisation companies, reconstruction companies and qualified institutional buyers. As the borrower was not within those categories and no separate written arbitration agreement existed, the statutory deeming of written consent could not be relied on.</description>
