    <title>2002 (3) TMI 879 - HIGH COURT OF KERALA</title>
    <link>https://www.taxtmi.com/caselaws?id=108939</link>
<description>A landlord cannot claim bona fide need for own occupation under section 11(3) of the Kerala Buildings (Lease and Rent Control) Act merely because the premises are required for the office of a private limited company in which he is a director or shareholder. The court applied the principle of separate corporate personality and held that an incorporated company is distinct from its shareholders and directors, so its requirement cannot be equated with the landlord&#039;s personal need or the need of a dependent family member. The claim was therefore not maintainable on that ground, and the eviction order was set aside in favour of the tenants.</description>
