    <title>2003 (9) TMI 548 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=108320</link>
<description>A challenge to a non-speaking arbitral award under the Arbitration Act, 1940 is confined to misconduct, perversity, or an error apparent on the face of the award. The court cannot reappraise the merits, substitute its own construction of the contract, or interfere merely because the award gives no reasons or another interpretation is possible. Construction of the contract and assessment whether the claim falls within the contractual framework remain matters within the umpire&#039;s jurisdiction. On this basis, setting aside the award was held unsustainable and the award could not be interfered with on the grounds relied on by the courts below.</description>
