At the section 11 stage, the court&#039;s role is limited to facilitating constitution of the tribunal and should not expand into final adjudication of such jurisdictional or contractual disputes. A challenge to a section 11 order remained maintainable where the order had been rendered in an adjudicatory manner on contested issues beyond the limited function of section 11 proceedings.</description>
