    <description>An arbitral order fixing the place of arbitration may be challenged when made, because a venue determination affects the conduct and legality of the arbitral process and need not await the final award. An application under section 8 of the Arbitration and Conciliation Act, 1996 does not attract section 42, as section 42 applies only to a substantive application concerning the arbitration agreement or arbitral proceedings. Where the arbitration clause fixes the place of arbitration in writing, that venue cannot be altered unilaterally by the arbitral tribunal in the absence of a subsequent agreement between the parties; the tribunal must proceed in accordance with the contractual venue.</description>
