    <title>1990 (5) TMI 180 - HIGH COURT OF DELHI</title>
    <link>https://www.taxtmi.com/caselaws?id=101957</link>
<description>In prosecutions under section 630 of the Companies Act for wrongful withholding of company property, criminal proceedings need not be stayed merely because related civil suits are pending. The court held that a civil dispute over title, tenancy, allotment letters, or possession does not by itself justify suspension of the criminal case unless the issues are so bona fide and intricate that prior civil determination is necessary. The criminal court may decide the matter independently on evidence. The stay orders were set aside and the complaints were directed to proceed.</description>
