    <description>Even where a secured creditor stands outside winding up, the company court retains jurisdiction under section 446 to decide claims, priorities and related questions concerning the secured asset. The amendments to section 529(1) and section 529A require workmen&#039;s dues to be ascertained and the statutory pari passu and overriding priorities to be worked out before security is realised. A secured creditor cannot insist on independent enforcement and sale of mortgaged assets free from the company court&#039;s supervision where workmen&#039;s claims remain to be determined. The security must therefore be realised in accordance with the liquidation court&#039;s control and the statutory scheme protecting workmen.</description>
