    <title>1975 (2) TMI 67 - HIGH COURT OF DELHI</title>
    <link>https://www.taxtmi.com/caselaws?id=99423</link>
<description>Section 392 of the Companies Act, 1956 gives the court continuing supervisory power over a sanctioned compromise or arrangement, including the power to modify the scheme and extend time without convening a fresh meeting of creditors and shareholders. That power may be exercised to secure effective implementation and is supported by rules 86 and 87 of the Companies (Court) Rules, 1959. Where the undertaking remains workable and creditors support continuation, the court may prefer supervised continuation with safeguards over winding up, especially if external difficulties have delayed performance. The scheme was therefore continued under extended time and additional oversight measures.</description>
