    <title>1974 (1) TMI 78 - HIGH COURT OF KERALA</title>
    <link>https://www.taxtmi.com/caselaws?id=99406</link>
<description>An order passed in misfeasance proceedings under section 543 of the Companies Act, 1956 may be enforced as a decree, so ordinary execution modes under section 50 CPC are available. The Kerala HC held that the limitation on passing compulsive orders directly against heirs or legal representatives in the misfeasance jurisdiction does not bar execution of an existing order against the deceased director&#039;s estate in the hands of legal representatives. The liability could be declared in the misfeasance proceedings, and lawful remedies against the estate remained open. The objection to execution was rejected and appointment of a receiver was upheld.</description>
