    <title>1967 (9) TMI 46 - Supreme Court</title>
    <link>https://www.taxtmi.com/caselaws?id=98393</link>
<description>A winding-up petition need not be advertised immediately upon admission because the Companies (Court) Rules, 1959 allow judicial control over the timing of advertisement and require advertisement only before hearing. The court may also, under its inherent power preserved by Rule 9, stay or suspend advertisement where necessary to prevent abuse of process or to secure the ends of justice, including cases where the petition is alleged to be not bona fide or filed for an ulterior purpose. The rules therefore permit postponement or restraint of advertisement in an appropriate case.</description>
