    <title>1986 (10) TMI 234 - CEGAT, CALCUTTA</title>
    <link>https://www.taxtmi.com/caselaws?id=72761</link>
<description>Where the identity and ownership of seized goods are disputed, adjudication must be a speaking order based on a full appraisal of material facts such as the ship&#039;s name, rotation number, weight and carton description. An order that ignores those indicators and fails to address competing claims is defective for want of reasoned consideration. Where a claimant to the goods has a direct interest and the proceedings are initiated on the basis of his complaint, he is a necessary party and must be impleaded and heard. Failure to give notice and an opportunity of participation vitiates the adjudication and justifies remand for fresh decision.</description>
