RBI amends Foreign Exchange Management Regulations; loans over USD 100,000 need international bank guarantee.
The Reserve Bank of India issued an amendment to the Foreign Exchange Management (Borrowing or Lending in Foreign Exchange) Regulations, 2000. Effective upon publication in the Official Gazette, the amendment modifies sub-regulation 4 of regulation 5. It stipulates that if a loan amount exceeds USD 100,000, the overseas borrower must provide a guarantee from a bank of international repute located outside India in favor of the lender. This change aims to enhance the security and reliability of foreign exchange borrowing or lending transactions.
